HB26-1134: Municipal Court Fairness and Transparency

★✔ PRIORITY SUPPORTPASSED & SIGNED INTO LAW 🎉
Sponsors: Reps. Mabrey, Velasco; Sens. Amabile, Weissman.

HB26-1134 extends basic legal protections already available in state court to the most vulnerable Coloradans: those prosecuted for poverty in many of our city courts. HB26-1134 brings municipal courts into closer alignment with state courts in access to indigent defense counsel, transparency, and record-keeping of court proceedings.

SB26-112: Court Actions Related to Failure to Appear in Court

★✘ PRIORITY OPPOSEDEFEATED IN SENATE 🎉
Sponsors: Sen. Zamora Wilson; Rep. Soper.

SB26-112 would undo a 2019 law that ended cash bond and prohibited extended pretrial detention for people charged with lowest level offenses, most often tied to poverty. The new bill would allow judges to set cash bond for minor offenses, jailing poor people for weeks or even months for simply missing court. SB26-112 would overwhelmingly impact unhoused Coloradans whose survival is already criminalized.

HB26-1039: Adding Municipal Jails to County Jail Oversight Requirements

SUPPORTPASSED AND SIGNED INTO LAW 🎉
Sponsors: Reps. Carter, Ricks; Sens. Jodeh, Weissman.

HB26-1039 requires municipal jails to abide by many of the same oversight and reporting requirements that already apply to county jails across the state. Aurora operates the only municipal jail in the state and this bill requires city officials to publicly report who they jail and why, allow inspection of the jail, and provide certain protections for pregnant people accused of municipal offenses.
